Administrative Discretion Regarding Board Policy


The San Benito County Board of Education (County Board) desires to be proactive in communicating its philosophy, priorities, and expectations for the county; clarifying the roles and responsibilities of the County Board, Superintendent, and other administrators; and setting direction for the county through written policies.  However, the County Board recognizes that, in the course of operating schools or implementing programs, situations may arise which may not be addressed in written policies.

In any situation in which immediate action is needed to avoid any risk to the safety or security of students, staff, or property or disruption to student learning, the Superintendent or designee shall have the authority to act on behalf of the county.

As necessary, the Superintendent or designee shall consult with other staff, including the legal counsel and/or the chief business official, regarding the exercise of this authority.
